Lawyers…they can seem like used car salesmen.  I saw a website today for a local attorney.  This lawyer said he was an advocate, he was experienced in family law, years of litigation experience…all of it a gross mischaracterization.  This lawyer is inexperienced…to say the least.  He was single to boot.
Divorce Lawyers come into cases and typically create more problems.  That’s just a fact…especially inexperienced divorce attorneys.  I heard this appropriate analogy recently and it stuck with me: “Lawyers in a divorce case come to your home, urinate in your “marital swimming pool,” and expect you to happily swim in it for the rest of your lives.”  There is a lot of truth to this analogy.  You must choose your divorce lawyer wisely.  Here are some general thoughts when choosing a Colorado divorce attorney:1.  Testimonials:  The more the better, especially from 3rd party websites like www.avvo.com.  They have a formula they use that rates lawyers.  The ratings include testimonials, both good and bad, and notify you if there has been any attorney discipline.  I have testimonials on my website, like many other lawyers, but I’m certainly not going to include negative testimonials.  www.avvo.com includes them all.  I have a negative testimonial on there…and I’m not happy about it either.  It goes to show that not everyone is a match and expectations and goals are not always met.  Testimonials are referrals from people you haven’t met.  They are valuable.2.  Read, read and read:  Read the divorce lawyer’s website!  Learn about the lawyer but, most importantly, understand their approach!  So you are pissed off, your husband cheated on you, and you want to make him pay right?!  A lot of divorce lawyers love hearing that.  Pissed off people pay a lot of money to have a mouthpiece lawyer fight and fight for them.  Those clients want the biggest “asshole lawyer” they can find.  And, believe me, there are plenty of those in Colorado.  In the end, all you end up with is more resentment, more anger, and a huge legal bill.
The better approach, the best approach, is to find an intelligent, sophisticated, strategic lawyer that provides you with legal counsel and advice based upon your overall goals and objectives.  The situation you are in is not the situation you want to be in later, right?  So you don’t want a lawyer that shares your temporary temperament.  You want a lawyer who represents you at your best:  strategic, focused and knowledgeable.  Long term guidance with short term solutions.3.  You get what you pay for:  If you have a low-asset case with no children then cost is certainly a factor.  If there are children involved and you are unable to co-parent together, or you believe you are entitled to maintenance, or you have concerns about your spouse’s behavior with the children, you, finances, etc. then hire the best lawyer you can find.  Don’t go cheap.  The good ones will work with you on payments.  We always do.4.  Trust your instincts:  Did they call you back in a timely manner?  Did they listen to your concerns?  Did they ask about your goals?  This is a big decision…listen to your gut.
